I thought this was a great recommends video feature after what was achieved in London this year plus its always good to see what other people think of the capital.

I personally loved the whole video, the production, the words, the way it was developed - the whole concept is a great idea.

Poem: I'm Not Famous

Standard

You might not be famous but that doesn’t mean
That you didn’t have a tough time as a teen
And you didn’t have to smile when you wanted to break down and cry
Because people where asking too many questions, trying to get you to lie

Sometimes you have to stand tall
Even though you want to crumble and fall
Sometimes you’ll feel like you’re being dragged through
With everyone telling you, that you’re doing things wrong
All you can do is stand strong
The only thing getting you through day to day
Are the dreams people tell you are getting in the way

You don’t need to be famous
To achieve greatness
Just believe in yourself and you’ll get there
It doesn’t matter if people stop and stare
As long as you follow your dreams
In which you’ve always been able to believe
No matter how big or small they are
On you’ll be sure to achieve
And in your own way you’ll become a star

Poem: A War We'll Never Know

Standard

They’re fighting a war we’ll never know
Just wishing for them to come home
But instead they’re out there
Doing the things we’d never be able to bare
Putting their lives on the live
Not knowing what they’ll find
Some have come home with battle scars
Some have come home in funeral cars
Others have mental scars
However they come home
They will never be alone
For we should give them as much support as we can give
For without them this life we’d be unable to live

We should remember the freedom they have given everyone
We have no reason to whine or moan
Because we are still walking the earth under the sun
With the chance to see are children play and have fun

Without them we wouldn’t have this life
Or the chance to hope and dream
So if things are the way you wished they’d be
Take a minute to think of those who have lost their lives fighting for you and me

Poem: Dear Santa

Standard
Dear Santa, It's that time of year
When we ask you to listen with open ears
I know that this Christmas there will be a few who will shed a tear
When they think of a beautiful little girl who can't be here

I'm not writing to you to ask for material things
Just for you to visit a little girl with angel wings
I hope you won't mind,
Especially as she won't be hard to find
For she is the brightest star in the sky

She didn't get a chance to walk this earth
So no present will truly show her worth
For she is the smallest angel in the sky

We didn't get to hear her cry
Or to listen to her first words
As she was already flying higher than the birds

She can't write this letter for herself to ask for toys
Like all the other girls and boys
So I wish to ask for you to,
Deliver a simple message
And giver her the knowledge
That although she isn't here
We'll always hold our thoughts of her dear
Wishing that she could be near
Our love for her will remain strong
For in our hearts she will always belong

Sleep tight little angel tonight
For I will watch your star so bright
As I say goodnight

Business Notes: Law - Contractual Offers

Requirements of Contractual OFFERS

In order to be capable of acceptance it must be:


  1. INTENDED to be an offer.
  2. Definition of 'Offer' - Declaration by offeror by which he intends to be legally bound if his terms are accepted by the offeree.
  3. Be CERTAIN - It must be possible for the 'offeree' to know what his rights and obligations will be if he 'accepts' the offer
  4. And be COMMUNICATED to the offeree - if the offeree doesn't know about it he can't accept it.
  5. Must not have been TERMINATED - an offer can’t be accepted once it has been terminated/ an offer can't be terminated once it has been accepted


The Difference between an Offer and an Invitation to Treat

Definition of 'Offer' - Declaration by offeror by which he intend to be legally bound if his terms are accepted by the offeree.

Therefore it depends upon the intention, for judicial guidelines see:

Boots Chemist Case (Pharmaceutical Society of GB v Boots Cash Chemist 1953)
The display on the shelf was only an invitation to treat (I to T), customer then made an offer to which the cashier can then accept or reject. This results in Boots NOT being 'guilty' as the sale was complete bu the cashier with a pharmacist present.

Fisher v. Bell for guidelines in accordance to shop displays
The defendant wasn't 'guilty' as there is no offer for sale as the display is an Invitation to Treat.

Partridge v. Crittenden for guidelines in accordance to adverts.
The defendant is not 'guilty' as he's not offering to sell he's offering an Invitation to Treat. This is because he's not making an offer to sell, the buyer is offering to purchase.

Other cases to look at:

Carill v Carbolic Smoke Ball Company 1893
The court held that the wording of the advert showed sufficient intention to make it an offer contrary to the general guideline laid down in Partridge v Crittenden.

Gibson v Manchester City Council 1979
Due to the wording there was no contract made.

Why Is It Necessary To Identify The Parties

  • It is the Offer's terms that govern the contract
  • It is the action of the offeree that concludes the contract (Both bound at this point)
  • It is the country in which the acceptance becomes effective which determines the applicable law (Can be stated a 'Proper' law ie country)

Termination of a Contractual Offer
  1. Refusal/Rejection - Once an offer is refused it is then terminated, the offeree cannot then change his/her mind and accept if they do then they will actually be making a new offer.
  2. Counter Offer - If the offeree attempts to accept, but introduces new or different terms, this is a counter offer, and the other party can then choose whether they wish to accept or reject it.
  3. Revocation - The offeror can withdraw his/her offer at anytime before valid acceptance has occured, provided: Revocation is communicated to the offeree and the offeree has not purchased an option
  4. Time Lapse - If no time for acceptance is stated, the offer will lapse after a 'reasonable' time; this will depend upon the nature of the commodity.
  5. Death - The death of a specific offeree will terminate the offer as only he/she could have accepted it. The death of the offeror will only terminate the offer if the offeree was aware of it before he accepted, otherwise the offeror's personal representatives must carry out the contract, unless it is for personal services.

What is a Contract?

A contract is a legally binding agreement between 2 people (it does not need to be written!)
Written contracts are mainly for proof (such as a receipt in shops are evidence for the purchase which you have just made) or to look back on what was agreed.

Contracts Gives Parties RIGHTS & OBLIGATIONS

Some contracts must be in writing because statute requires it, for example:

Property
Finance (credit) - inc. phone contract
Employment - - need to know to be able to refer to it

Four 'Ingredients' Must Be Present in Order for a Contract to Exist

1. Offer
2. Acceptance (an agreement, not yet a contract)
3. Consideration
4. Intention to create legal relations

All four of the above must be present in order for a contract to exist. If one is missing then there is no contract between the parties.

·         By breaching a CONTRACT - results in damages being paid if successful
·         By committing a TORT (Civil wrong) - results in damages being paid if successful
·         By breaching a STATUTE - results in damages being paid if the Act creates civil liability or a fine if the Act creates criminal liability

Adversarial Procedure - Trial in which judge acts like the referee in the context between two opposing litigants.

Claimant -The party who brings a civil action

Common Law - Various meanings determined by context: law applicable to the whole of England/ judge-made law rather than statute/not the law of Equity

Crowm - The prosecutor in criminal proceedings

Defence - The person being prosecuted/ their legal representatives

Defendant - Person against whom criminal or civil proceedings are brought

Precedent - Previous judicial decision influential and possibly binding in later cases

Business Notes: Introduction to Law

We need to know the difference between criminal and civil law (we will focus upon civil law but occasionally touch upon criminal law).

Civil Law = us as individuals exerting our rights

Businesses are civally liable to their customers in many circumstances but crimanally liable in other circumstance. However most customers do not know what their rights are (some businesses use this to their advantage).

Criminal situations are usually quick because the freedom of the individual is at risk, therefore they are usually released the following day. However the civil process takes a long time for any conclusion to be made.

The two courts for civil cases are:
  • ·         High Court
  • ·         County Court


Within civil law you don’t use the term 'guilt'

Recommends: Syner ft Jesskarz - Circle Of Vice (Video)

I'm posting this video as a recommended track/ video because I don't think a review would be able to do it justice.The lyrics are hard hitting, fits the beat and the artists deliver it amazingly! After I watched this I checked out Jesskarz other videos on YouTube and even downloaded her mixtape - I definitely think there is a lot more to come from her in the future and is someone to keep an eye on.
